All use of the website www.hireapitch.co.uk (‘the Site’) is on the terms and conditions below. If you do not agree to these conditions you must cease use of the Site immediately.

We recommend you print and keep a copy of these terms and conditions. They are a legal agreement and can only be modified by you with our consent. We reserve the right to change them at any time by posting new terms on the Site.

  1. Accuracy of Information and Disclaimer

We do our best to ensure all information on the Site is accurate. However this Site provides large amounts of data and it will inevitably contain some errors. We therefore cannot guarantee it is accurate, up to date or complete and to the extent permitted by law accept no liability for any loss or damage caused by inaccurate information.

You should independently verify any information before relying on it. If you find any inaccurate information on the Site, please let us know and we will correct it, where we agree, as soon as practicable.

By completing the registration process you confirm that you are eligible to use the Service, and that you agree to be bound by all of these Terms. In consideration of your use of the Service, you agree to:  

(a) provide true, accurate, current and complete information about yourself as prompted by the Service's registration form (such information being the "Registration Data").  

(b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete.  

If you provide any information that is untrue, inaccurate, not current or incomplete, or hireapitch.co.uk has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, hireapitch.co.uk has the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof) Without a refund of any monies paid.  

You will receive a password and account designation upon completing the registration process. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account. You agree to  

(a) immediately notify hireapitch.co.uk of any unauthorised use of your password or account or any other breach of security.  

(b) ensure that you log out from your account at the end of each session.  

hireapitch.co.uk cannot and will not be liable for any loss or damage arising from your failure to comply with this Section 3.

You agree that all information, whether publicly posted or privately transmitted, are the sole responsibility of the person from which such Content originated. This means that you, and not hireapitch.co.uk, are entirely responsible for all Content that you upload, post, email or otherwise transmit via the Service.  

Hireapitch.co.uk does not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content. Under no circumstances will Hireapitch.co.uk be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed or otherwise transmitted via the Service.

Hireapitch’s definition of 'objectionable' includes crude or racist remarks and any form of personal abuse.  

(b) upload, post or otherwise transmit any Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under non disclosure agreements);  

(c) upload, post or otherwise transmit any Content that infringes any patent, trademark, trade secret, copyright or other proprietary and intellectual property rights of any party;  

(d) harm minors in any way;  

(e) impersonate any person or entity, including, but not limited to, a Hireapitch.co.uk official, Member, forum leader, guide or host, or falsely state or otherwise misrepresent your affiliation with a person or entity;  

(g) forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Service;  

(h) upload, post or otherwise transmit any unsolicited or unauthorised advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation;  

(i) upload, post or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;

(m) defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others;  

(n) collect, store, or distribute personal data about other users without their consent; or  

(o) promote or provide instructional information about illegal activities, promote physical harm or injury against any group or individual.  

(p) send 'mass mailings' - i.e. the same message to large numbers of other members.  

You acknowledge and agree that Hireapitch.co.uk may preserve Content and may also disclose Content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to:  

(a) comply with any applicable law  

(b) enforce the Terms  

(c) respond to claims that any Content violates the rights of third-parties  

(d) protect the rights, property, or personal safety of Hireapitch.co.uk, its users and the public.  

You understand that the technical processing and transmission of the Service, including your Content, may involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.

You irrevocably agree that the courts of England shall have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these terms and for those purposes irrevocably submit all disputes to the jurisdiction of the English courts. The place of performance shall be England.

You agree to defend, indemnify, and hold harmless Hireapitch.co.uk, its officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from your use of the Content, the Service, your connection to the Service or your breach of the terms of these Terms. Hireapitch.co.uk shall provide notice to you promptly of any such claim, suit, or proceeding and shall reasonably assist you, at your expense, in defending any such claim, suit or proceeding.

Any formal legal notices should be sent to us at the address at the end of these terms by email confirmed by post.

Failure by us to enforce a right does not result in waiver of such right.

You may not assign or transfer your rights under this agreement.

  1. Disclaimer

www.hireapitch.co.uk accept no responsibility for the standard of any venue of any referee that you may wish to hire. We are merely pointing you in the right direction and are not confirming such things at any particular venue such as the state of any particular pitches,facilities,fees etc. It is up to you to check the background of the referee. It is up to you (‘the hirer’) to check if they are fully qualified, if they have completed the safeguarding children workshop and are CRB checked amongst other checks. You could be breaking laws if you do not carry out these checks and proceed to hire an unqualified referee. This site takes absolutely no responsibility for any such issue that may arise from any person hiring an unqualified referee.

  1. Refund Policy

Apart from exceptional circumstances, Hireapitch.co.uk does not give refunds.  

Whilst we anticipate that you will receive a suitable amount of enquires and booking for your venue and or refereeing, we can make no guarantee about the number.  

We cannot guarantee that you can use the service 100% of the time. Whilst we strive for reliability, the Internet is inherently an unstable environment - like many websites we also occasionally suffer glitches and sometimes need to briefly close the site for short periods of maintenance.  

Hireapitch.co.uk does not tolerate bad behaviour. Hireapitch.co.uk, in its sole discretion, may terminate your account, with no refund of any fees paid, if it considers you have violated or acted inconsistently with the letter or spirit of the Terms or of other rules and guidelines posted on the site.  

You agree that you accept Hireapitch.co.uk's Refund Policy as described above.
